YOUR QUESTIONS
Frequently asked questions
In the initial consultation we establish the facts, what your legal position is, which routes are open and which route fits your aim.
Billing through legal expenses insurance is possible, but as a rule it does not cover the whole fee. Insurers usually only reimburse the statutory fees under the German Lawyers' Fees Act (RVG); you bear the difference to the hourly fee yourself. Whether your policy covers the area in question at all, and what excess applies, is quickest to clarify directly with your insurer. The request for cover and the correspondence with the insurer run through you; the details of the matter you need for that you get from me. Tell me at the outset that you have legal expenses insurance and I will take it into account in the planning.
Both: appointments take place at the office in Cologne or by video and phone, whichever suits you. Many matters run entirely digitally from the first enquiry to completion, documents included. Appointments are possible Monday to Thursday until 7 pm and Fridays until 5 pm, and later by arrangement, so that you do not have to account for half a working day. I can represent you throughout Germany, wherever the court happens to sit. Only before the Federal Court of Justice is a separate admission required, which I do not hold. I conduct cases in German and in English.
Yes, you can change your lawyer at any time, including during pending proceedings. Three points have to be settled in practice: where the matter stands including any running deadlines, the handover of the file, and the previous adviser's billing, whose fees already earned do not fall away because of the change. Before taking over I look at where the proceedings stand and what can still be moved, so that you do not pay for work to be redone that changes nothing about the outcome. Sometimes the result of that review is that a change at this point achieves nothing. Then I tell you so.
